The module comprises three main parts, each one contributing to an understanding of the aspects of the construction sector that are impacted by dispute resolution procedures. The breakdown of this module is as follows:
Part 1 – Review of principles of dispute resolution and disputes
Part 2 – Overview of existing dispute resolution options
Part 3 – Alternative Dispute Resolution (ADR) in common construction contracts.

Users intending to undertake the examination for this module are advised that this forms the primary material which is to be covered in depth and examined.

This folder contains examples of national Legislation and Organisation Rules dealing with various forms of Dispute Resolution - all practical documentation which students should examine and compare to similar material in their own countries

The documents lodged here all develop the primary content of the course material to an in-depth level. Whilst not required readings for students, this content can add considerably to their knowledge of the subject matter and can be useful in their future careers

The attached file entitled "How to participate in the arbitration process" (Extracted from 'Dispute Resolution' - Pretorius (Ed): 1993) forms the framework to this exercise and should be read prior to starting the assignment activities.
You are to make contact with a Quantity Surveyor that has personal experience in arbitration proceedings, and to identify an arbitration with which they have been involved. Using this as reference point / case study, you should consider, together with the arbitrator, the list of activities in the attachment and compile a detailed set of proposals covering all items, as they would ideally be handled in resolving the dispute. Full details supporting each item proposal should be provided, indicating all the considerations that would have to be taken into account.
